Landlord fined one third of the deposit for non-compliance
Posted on Friday 27th of February 2015In the latest ruling under the Tenancy Deposit Schemes (Scotland) Regulations 2011, a landlord has been fined one third of the deposit amount for non-compliance. In Jenson v Fappiano, the landlord failed to transfer a deposit of £1,000 to an approved tenancy deposit scheme or to provide the tenant with the Prescribed Information. The landlord was a first time landlord who had moved in with his father to let out his own home and had "no specialist knowledge of property...Read More

The Mission
Posted on Tuesday 17th of March 2015Welcome to my first blog post. I had planned to write this at the beginning of the year and already it's March – time flies when you're having fun! It's been nearly two years since I started at SafeDeposits Scotland, and for the majority of that time I have been very office focused, but for very good reasons. Finding and moving into our new Glasgow offices, bringing our call centre back in-house, growing the team, paying off our start up loan, treasury management of the increasing number of...Read More

Thousands in unclaimed deposits
Posted on Tuesday 31st of March 2015I feel like titling this blog post "Claim your free money here" but that might cause our internet and phone systems to crash, so I'll tread more carefully! When the Tenancy Deposit Schemes (Scotland) Regulations 2011 were passed by the Scottish Government, no one ever imagined that a tenant wouldn't want their deposit back when they moved out of the property they were renting – but, believe me, it happens all the time! As of March 2015, SafeDeposits Scotland have £400,000 of unclaimed...Read More

Preparing for The Agency Business
Posted on Monday 18th of May 2015It's all go at the SafeDeposits Scotland Glasgow office this week preparing for The Agency Business at Hampden Park on Thursday. The Agency Business is a conference dedicated to Scotland's letting agent industry, hosted by the letting agent arm, the Council of Letting Agents, of our partner the Scottish Association of Landlords. With the speaker programme just announced, it's set to be a great event, with 200 delegates from the private rented sector across Scotland attending. I was shocked...Read More

Happy birthday, SafeDeposits!
Posted on Thursday 2nd of July 2015Three years ago the introduction of the Tenancy Deposit Schemes (Scotland) Regulations 2011 meant SafeDeposits Scotland was born with the purpose of protecting millions of pounds worth of deposits in the private rented sector. This meant we had to convince a nation's landlords and letting agencies that SafeDeposits Scotland was the organisation they should entrust their deposits with. So three years on, where are we? Over 60% of Scotland's private rented sector has complied with the new...Read More

July adjudication digest: Agreeing or negotiating?
Posted on Monday 13th of July 2015The adjudication digest takes a recent decision by a SafeDeposits adjudicator and sets out the reasons behind it. We hope that you will find these digests informative in understanding how we reach our adjudication decisions. This blog post is for guidance only – it is not intended to guarantee when an award will be made. Each dispute is different and the actual award made will be based on our interpretation of the specific evidence presented to us. Agreeing or negotiating In...Read More
